CONSTITUTIONAL LAW TUTORIAL DISCUSSION 2 a) Discuss the fundamental difference between the provisional organic law and the ruling under Kaseng v Namaliu. The provisional laws are organic laws that were enacted before the constitution came into operation. The organic laws were enacted by the National Constituent Assembly before the Independence. According to section 266 of the constitution it states: (1) If before Independence Day the constituent assembly has made an instrument expressed to be a provisional organic law, the instrument takes effect, on Independence Day, as if it were an organic law made and coming into effect on that day. 2) If before Independence Day the constituent assembly has made an instrument expressed to be a provisional act of parliament made for the purpose of bringing any provision of this constitution into effective operation on Independence Day, as if it were an act of parliament made and coming into effect on that day. Therefore the provisional organic law s take its effect on the independence day of Papua New Guinea on the 16th of September 1975. The organic laws were adopted into the constitution and ‘force of laws’ were given to these provisional laws.Thus the provisional organic laws were enacted and came into operation together with the constitution since the constitution has to come into power first before it expressly authorised the organic laws as stated in section 12(1) (a) where it state; â€Å"an organic law is a law made by the Parliament in respect of a matter of provision for which by way of an organic law is expressly authorised by the constitution. † However in the case of Kaseng and Namaliu [1995] PNGLR 481 the premiere for western province Isidore kaseng on behalf of all premieres is arguing against the passing of constitutional amendment No 16.In this case the authorising law which is the constitutional amendment No 16 is not yet being enforced when they propose to amend the organic law on provin cial government, thus the passing of the OLPGLLG was referred to as void by kaseng because it is inconsistent with the constitution under section 12(1) (a). Therefore the fundamental difference between the situation in the ruling of kaseng v Namaliu and the provisional organic laws is that on the former case the enactment of the provisional law takes place at different times while the proposal law and constitutional Amendment 16 occur at the same time on the latter case. ) Discussion Discuss the case of NTN pty v The State [1986] PNGLR 167 In this case the contract was between the NTN pty the applicant and the State. Here the state went into an agreement with the NTN pty to start a commercial television station to an existing one. They agreed to start their broadcasting according to clause 4. 2 of their contract on 14 July 1986. The NTN pty limited then got itself a licence and venture into the business. However there was a change in the government on July 10 1986.The new government through the parliament exercised its legislative power under section 109(3) (b) and enforced a new parliamentary act the radiocommunication (television) regulation in 1986. This act prohibits the broadcast of television until 31st January 1988. Thus, from this cause the NTN pty filed a case against the validity of the act. The state claim that the electromagnetic spectrum is within the borders of PNG and so no one has the right to access it since it’s the property of PNG unless given permission.The state further on to claim that the act made is not against the fundamental right to freedom and expression and publication. Therefore the NTN pty applied to the national court pursuant to section 57 of the constitution claiming its right to the freedom of information under section 46 of the constitution. Thus the situation went into appeal to the Supreme Court and the Supreme Court held that the Act was unconditional since it did not comply with section 38 and it also violet the a pplicant’s right to publish and broadcast information under section 46 of the constitution. (c) Discussion i) How the constitution can be altered as specified under section 13 According to section 13 of the constitution it states â€Å"this constitution may be altered only by law made by the Parliament that- (a) Is expressed to be a law to alter this constitution; and (b) Is made and certified in accordance with section 14 (making of alterations to the constitution and organic laws). Therefore section 13 clearly state that to make alteration to the constitution the law must be expressly authorised by the constitution and also it must in accordance and certified with section 14 of the constitution.Section 14 provides with the steps to follow before a proposed law is introduced into the parliament. When it enters the parliament the speaker will then certify that law in the parliament. Thus to alter the proposed law to the constitution by the parliament that same formality must be followed with the support of the majority of votes as stated in section 17 of the constitution. (ii) In the making of alteration of the constitution and the organic laws under section 14 and 17 of the constitution, the procedure the parliament has to follow is firstly to propose a law to alter the constitution or organic law.Since these are no ordinary laws the laws must be carefully supported by a majority of vote as stated in section 17 of the constitution whereby it states â€Å" subject to this section, in relation to a proposed law to alter a provision of this constitution the prescribed majority of votes for the purpose of section 14 ( making of alterations to the constitution and the organic laws) is the majority of votes prescribed by this constitution in relation to that provision, or if no majority is prescribed a two third majority vote. However the parliament must debate this proposed law during different meetings of the parliament and separated in time by at least two months as stated in section 14 (2) (a) (b). further on section 14 (2) (b) state â€Å"†¦the proposed law must be published by the speaker in full in the National Gazette, and calculated, in accordance with the standing of the parliament, to all members of the parliament not less than one month before it is formally introduced into the parliament. When the proposed law finally circulated to all members of the parliament then the speaker will announce under the National seal and according to the parliament standing orders section 100, when the procedure is complete the new law will then come into operation. Leadership and Organizational Behavior Essay

Armor Valley Services (AVS), LLC is a company that provides programs that are specifically developed to meet the needs of anyone who qualifies for hospice care, personal care or homemaker programs, from the simplest custodial care to the most complexes concern. They recognize ease the emotional, physical and financial strains imposed upon the client and family. AVS is focused on building a working environment where people are better able to succeed. It encourages achievement with personal triumph as a major contributor to success. With this culture being at the top we are able to introduce a friendly virus within the organization. People are aligned to common goals and objectives to help with safety awareness. Even though, more training is needed to help accomplish this, the members all have a common direction of taking care of the client’s needs. These results indicate that my organization is dedicated to the members actively support each other to identify problems and find workable solutions. I am a Personal Care-giver, as such, I conduct services such as bathing, cleaning, preparing meals, sitting with clients and assisting them with the daily needs of life. I have been working part-time with AVS since September of 2009. The problems observed are the lack of training and personal care given to the individual patient. Most of the patients are elderly or unable to do for themselves. So we have to take the extra step to make them feel needed and want to give that extra push to live. Also untrained personnel can cause someone to lose their life. Even though this is a small upcoming business all precautions should be taken to ensure safety first. This is a very important aspect for me, because I don’t want anyone hurt from a lack of knowing. Other problems observed, is the lack of work for the personnel. If you don’t have enough patients for a worker, why hire another person to work and you are giving both workers part-time work. On the other hand, I understand why because it keeps the employer from having to provide any benefits. Preliminary Problem Statement AVS does not have enough well-trained employees for this type of job. We are dealing with elderly clients that have a multitude of problems. We are not trained in medical emergencies, to include CPR. I have abreast myself in ensuring that I have just the basics of CPR and the knowledge to know when emergency assistance is needed. Having untrained employees can cause risk, law suits and cause someone to lose their life. AVS also is trying to cut down their cost by not providing sufficient hours to their workers. Having insufficient hours can cause a big turnover and lack of enthusiasm in your workers. With these working conditions, how can the worker efficiently do their job; how can the clients get the best possible service; and how can the company retain and maintain the best possible work ethics, if their main focus is on cost effectiveness? The TCO’s my problem is related to are B- given the influence of factors such as values, attitudes, beliefs, feelings, and personality on individual behavior, demonstrate how knowledge of individual difference factors to help in understanding, predicting, and influencing individual behavior and C- given the array of theories of motivation, demonstrate their application to successfully guide employees toward accomplishing organizational objectives.

Un Action Against Terrorism Essay The issue of coming up with ways to combat terrorism has been prioritized by the entire community internationally and it is also a major task in the United Nations. Various UN bodies have come up with different initiatives to try and combat terrorism and bring to justice those involved with the act. The most controversial issue within the UN in its battle against terrorism is the counter terrorism measures that are stipulated in the resolutions of the UN Security Council. One of the most serious threats towards human rights in the world is terrorism as it takes lives of thousands of innocent people every year and also breaks democratic orders. It is quite important for Countries to react to any threat of terrorism but at the same time there have been concerns that some forceful measures against terrorism may also greatly violate the human rights. The UN requires balancing the two competing interests in the fight against terrorism which are individual rights on one hand and protection of civilian and national security on the other hand. In some exceptional circumstances to curb threats and activities of terrorism there may be some justification to the abuse of human rights but only when it is an emergency case. It is very important for any country to ensure that any decisions that are made in order to preserve national security are according to the law, compensation is done to individuals whose rights were violated and those decisions should be subjected to review in the near future to avoid violation of human rights. The UN did not make any attempt to resume or revive the efforts that the League of Nations had made to control international terrorism after these rules were greatly interrupted by the Second World War. These efforts had finished the integration of the 1973 complementary conventions to deal with the punishment and prevention of terrorism and also the establishment of an International Criminal Court. This has resulted in a problem of international terrorism as it has been observed in a number of actions that have been carried out by the UN involving progressive development and codification of the international law since the early 1950s. Before the year 1972 the issue of terrorism was not a major topic of discussion in the general assembly of the UN. In 1972 there was a kidnapping of Israeli athletes at Munich during the Olympic Games, as this was seen as an act of terrorism, the then Secretary-General of the UN introduced an item on measures to curb terrorism and any kind of violence that would take innocent lives or endanger any human fundamental freedom to be discussed in the twenty-seventh session of the United Nations National Assembly. In 1985 the General Assembly of the UN pointed out that there may be some cases in which the perpetrators may be pushed to terrorist acts by violation of the human rights; it also urged Nations and the UN organs to make contributions to the progressive elimination of any causes underlying international terrorism. Sri Lanka is one of the examples where the UN failed to fight terrorism; this is clear in that the Sri Lanka government was able to reduce the LTTE power from being a formidable organization to a mediocre organization. The LTTE is one of the most cruel and ruthless terrorist groups that can use any weapon to cause mass destruction of property and loss of life. The UN took no action to try and bring to an end the LTTE group of terrorists but fortunately the Rajapaksa government succeeded in defeating the LTTE. The main objective of the UN is to settle disputes between countries by use of diplomatic approaches before the countries decide to use military force or before the conflict becomes uncontrollable. Unfortunately the UN has not attained this goal. The UN is a forum where member states send representatives to argue for or against their countries. These representatives have been seen to be just spokesmen for their country but back in their country they do not have any power or influence. Another issue is that those countries that are ruled by dictators or those that are not at peace use the UN debates to delay and complicate issues in their favour. Over the last fifty years during the existence of the UN the debates have not resolved any issues but threats, direct military action and hidden negotiations that were not sponsored by the UN have had positive changes in solving most of the conflicts. An example of this is the case of Iraq which was under the UN forces for over 100 years during which the Iraqi people were subjected to sufferings while on the other hand Saddam Hussein continued with his dirty games with the UN of only allowing inspection of weapons of mass destruction at certain periods and also coming up with solutions to the oil for food agreement imposed by the UN. This stalemate was broken by the United States of America by invading and overthrowing the Saddam regime. Had this stalemate not been broken the people of Iraq would still be under the oppressive rule of Saddam. The UN has also been unable to take actions that are direct and independent without seeking the support of its members. In the current world which is full of oppressive regimes and war mongering dictators who understand that the UN lacks any real power therefore making them free to do anything they want. For example the North Korea has been testing nuclear weapons and it has currently threatened to do it again while the UN is just considering an act of sanctions. If North Korea today decides to use the nuclear weapons in an act of terrorism many people would end up losing their lives just because the UN failed to take action in time. The member States of the UN should then be urged to contribute equal military force or money that is equivalent. The UN should then have these resources at its disposal and it should be free to use it without any approval from any of its member states. There are 5 selected member countries of the UN that can disagree on any decision that the majority of the States had agreed upon. These countries are China, USA, Russia, United Kingdom and France because they founded the UN that came up with the rules of UN after the Second World War. This has resulted in a lot of problems in the UN because these countries with the veto power were not elected democratically and therefore there is reason to believe that the decisions that the countries take are truly biased. This is a problem that has greatly caused people in this world to lose lives and it is not aimed to come to an end any time soon because the countries with the veto power are not willing to give up this power and allow for fair selection. The other failure of the UN is that most of its members are not countries geared towards peace and have questionable voting practices. The only solution to solve this problem would be to deny such nations the power to voting during any meetings of the UN. This is not easy to implement because countries debate in the UN forum only if they have the right to vote in the UN Security Council. UN considers itself a humanitarian body while on the other hand it continues allowing non-humanitarian countries like China to vote on humanitarian issues. The other area where the UN has failed to take action on terrorism is by the fact that UN does not formally recognize any State as a terrorist. Terrorists on the other hand would not debate in a public forum like the UN or seek help from the UN to sort out their issues and this clearly shows that the UN does not get involved in any way with the terrorists. Due to this the UN has been seen to be completely blind to terrorists and it has no intentions of addressing the terrorists and this is not likely to change soon. UN being the largest organization in the world that promotes peace should not be completely unable to address terrorism and therefore this has been seen as a complete failure to the UN in fighting terrorism. The United Nations has also been seen to fail in the action against terrorism because it has for a long time been unable to clearly define terrorism without putting policies that would annoy some of its strongest member states. UN has found itself in a state of confusion as Islamic states argue that the fight against occupation should be exempted from the definition of terrorism as this is well stipulated by the UN in the Organization of Islamic Conference (OIC) of 1998 which clearly states that the struggle of the people either peaceful or armed struggle against any foreign occupation shall not be termed as an act of violence. The issue of terrorism as been complicated more by the fact that the struggle of the people to free themselves from any foreign occupation and/or colonialism does not in any way constitute an act of terrorism. Some of the Islam clerics have also considered the presence of the US and other foreign forces in Afghanistan and Iraq as occupation and therefore they do not term any act of the citizens of this country to free themselves from foreign occupation as an act of terrorism. Due to lack of a definition of terrorism there has been failure of the UN to come up with a complete detailed convention on international terrorism but instead it has adopted a document it calls Global Counter Terrorism Strategy which is based on an unknown definition of terrorism. In conclusion the UN has failed in many areas in the fight against terrorism. For the UN to fight terrorism globally it should be in a position to address terrorists and come up with ways of preventing anymore loss of lives. Marketing communication mix ABSTRACT: The whole work revolves around the subject of marketing communication mix. Considered to be derived from marketing mix. Communication mix consists of advertising, personal selling, sales promotion, direct marketing and PR. For I-phones they use caples principle of advertisement. Advertising is effective but expensive Personal selling is expensive but is considered as cost-effective Sales promotion uses pull or push strategy. Direct marketing is common way used now days. To select right communication mix we should always use products life cycle to determine. Should keep a good eye on products sale to find the most effective way for advertisement Characteristic and role of each and every communication mix differ. LITERATURE REVIEW: I followed three different books and used AIDA, john caples principle and example of i-phone in my assignment. Most of the items I used were written by Philip kotler. I tried to use some facts and figures to prove my findings and as books being credible source I tried to use them rather than using internet sources. Mostly pictures are copied from internet only and all the items are referenced accordingly. Dr. kotler is considered one of the worlds leading authority on management and is considered pioneer writer in the field of international marketing and branding. MARKETING COMMUNICATION MIX: In this era of digital technology and competition, no one can survive without marketing; either its the product, brand or a service. The best definition of marketing was given by Al Ries and Trout â€Å"marketing is the performance of those activities which seek to accomplish organizations objective by anticipating customer or client needs and directing flow of need-satisfying goods and services from producer to customer or client.†(Source: Al Ries, Trout jack, 2006, marketing warfare, McGraw hill companies. Inc.) MARKETING MIX: Marketing alone couldnt be taken on account to anticipate and fulfill the customer needs. To just check the existence and evidence of presence of marketing communication mix we will look at 7 Ps of marketing. In 1960 Mccarthy came up with 4 Ps of marketing. The marketing mix according to some authors was already used as term before her in 1940s while later in 1980 booms and Bernard came up with 3 more Ps. The use of these 3 Ps is still debatable and is criticized by many people. The communication is required between the customer and the business in order to increase the transactions or to maximize the daily sales of the business. It is important to mention here that the right communication mix is important to be chosen which suites the business needs and is the clearest way for the business to convey the message. In 1961 according to the same author Albert Frey was the first one to distinguish between communication tools and offering. Simply saying offerings are the service u offer used e.g. product, price and brand etc while tools you use such as place; promotion etc. so according to him which ever way you take you will use all your approaches for people. Most of the times we see the I-phone holding the whole last page of newspaper and showing what this product can do and the other ordinary phone might not be able to. The product before and after launch is advertised so many times to remind the customer of the phone that a lot of customers are attracted. As result many customers buy the product and we normally see the line in front of apple shops when the product is launched. They use sale promotion strategy for ending line of product. I.e. they used the sales promotion where they were finishing line of 2.5g (1st generation I-phone) where they reduced the price of phone, in order to boost the sale and finish the line of product when it was on declining stage. This helped company to get some potential customers. ADVERTISING: Advertising is said as very simple but expensive form of promotion. Advertising can be different depending on product or media used. For example on TV or it can also be in the form of internet advertisement. But this is considered most expensive because anyone who uses this have to either use large campaigns or use their lots of time in this kind of promotion. Advertising is the form of promotion is considered as non-personal promotional mix because the business doesnt know if their message is received by its customer or not, do people understand the product etc. CHARACTERESTIC OF ADVERTISMENT: According to Kotler characteristic of advertising are Public presentation: advertising is considered as highly public mode of communication and people consider this kind of promotion more because they consider that the offer they have been made through the media is standard. Pervasiveness: it is the medium of communication where a seller can repeat its message many times and this as a result help buyer to compare the sellers product with other competitors or substitute available. Amplified expensiveness: means that if company use little bit of different way or expensive way from its competitor, it might result in getting buyers attention. Impersonality: means that the customer or buyer is not as much motivated to buy the product or service as much as he is through a sales agent. As it is one way communication so the customer might wants to know about the product but cant because he cant speak to advertisement. The most common way of advertisement is TV, radio, newspaper, broachers and magazines etc.The advertisement is really beneficial in creating long term relationship between consumer, product and business. E.g. coca-cola uses all time red color for advertisement of their product and uses same advertisement many times a day to attract customer. PURPOSE OF ADVERTISMENT: The main purpose of advertisement is to get buyers attention, which creates interest and a desire rises in customer following the action (buying). According to the same website UK advertising expenditure in 2008 was  £18.6 billion. Not only that but also if we notice in our daily life routine we might go to some place and pay attention to the product for which we have seen advertisement recently. Sometime on local buses we see some poster and think that do we need the product or not and sometime even though we dont need it we might end up buying it. PERSONAL SELLING: It is considered to be one of most cost-effective kind of promotion. Some books also consider this as the most expensive one as well because of wage cost to the company, travelling cost and the company always have to offer the people with some kind of incentives to boost sales. Personal selling is considered effective because the business can feel the consumers requirement and can make up a package for consumer in order to fulfill their needs. The consumer can also look at the packages that suits best to their needs and can also tell the sales representative about their needs .e.g. British gas etc. Normally we see people from gas and electricity companies doing this kind of promotion. CHARACTERESTIC OF PERSONAL SELLING: According to Kotler(1997) the main characteristics are Personal confrontation: involves consumer and business representative where the need of consumer can be felt by the supplier. They can either come to some point of agreement or the business can offer some flexibility to consumer in order to gain or retrieve a customer. Cultivation: means that the business can adjust their offers according to customers need in order to maintain good relationship between business and customer. Sales representatives mostly use affectionate and friendly kind of approach towards their customers. Response: means that the buyers mostly respond to their seller and their response can be taken in account to increase sale. The response can be either good or bad depending on what customer feels about the product. ROLE: The main role of personal selling is mostly Acquire new potential customers and provide old customers the best service. Try to sale the product efficiently After sale provide them with best services Close the sale If resources or stock become less try to allocate other resources to make sure that customer remain in business with us. Though this kind of selling is decreasing due to presence of media like internet, TV and telephones. The costly method still used but only by some companies. Most of the companies have changed with changing world. SALES PROMOTION: It is normally used to boost the sale mostly at declining stage of the product. It offers the customer with either discounts or some kind of other special offers which results in customer attraction and as a result customer buys the product. Normally business uses coupon, special offers ands discounts etc. This kind of promotion is only good for short term and doesnt lead to long term relationship between business and customer. For example some companies use even ebay to do their promotions by using bid auctions like a company called EOL (end-o-line). Another is example is to supply customer with offers like by 1 and get 1 free etc. CHARACTERESTIC: According to Kotler three distinctive benefits and characteristics are Communication: mostly this kind of promotion gets the customers attention and provides customer with the information which may lead to transaction. Incentives: the business introduces some kind of concession, offers or vouchers to increase the sale temporarily. Invitation: the customers are usually forced to do the transaction soon by saying either till stocks last or till the date. This helps business to get more transactions in the limited time. ROLE: Sales promotion normally uses push, pull. These play an important role in any sales promotion. The product might be sold again to one of the wholesalers or end consumers. This is normally used in B2B relationship. Sometime it is also used as a term that the business waits for the consumer to turn up and order the product and is produced, as they cant stock of the products life cycle. This is used for B2C relationship. Normally car suppliers and showrooms use this kind of strategy to promote sale to consumer and finish the old stock. PUBLIC RELATIONS: This kind of promotion is used by company to make their image better in public eyes. There is a different department for this kind of promotion. These departments mostly try to improve their companys goodwill in consumers eye. For example Durex the condom makers donated 50,000 condoms to NGOs in December on world aids day. The other thing they started was that they went to the social networking website â€Å"Facebook† and launched some games in order to increase awareness and sales. The company or business might do some charities or sponsor some kind of good cause. The companies might also use newsletter or news releases to improve PR. CHARACTERESTICS: According to Kortley(1997) role of PR is High credibility: most of the time people trust news or articles more than other like advertisement, personal selling or sales promotion. ABILITY: it is much easier to catch people who avoid personal selling. So the message is read by more people and this might result in more sales. DRAMATIZATION: it also has potential of setting company or product reputation at the level which company is not in real life. This can be the result of advertising as well. ROLES: In normal routine of life these people play an important role in image of a company as they are the one responsible for news releases and the charitable functions. The PR has to make sure that they do their work through the right channel so that it can be recognized by the people. E.g. they shouldnt help the cause of cutting trees as it might hurt many peoples feelings. They should try to reach those people who cannot be reached because they avoid personal selling etc. another thing that they should try to help campaigns with their product rather than money as it will improve the products sale and image. For example IBM provides non-profit companies with discounted price on purchase of their items. DIRECT MARKETING: This type of promotion is used by mails, telemarketing and catalog marketing. This is quite effective way of promotion because the response can be taken on account to increase sale or acquire new customers from other competitors. E.g. sometime we receive a call on our numbers offering different services or products (especially on landlines). Some other schools of thoughts also consider e-marketing as a part of this promotion type like e-mails for promotions or sales. (Kutler, 1997). CHARACTERESTICS: According to Kutler(1997), there are four types of direct marketing. Nonpublic: the letter or e-mail or telephone is for specific person who have subscribed to some offers. Customized: normally can be different for two different customers depending on their buying history. Up-to-date: offer can be prepared delivered quickly using e-marketing or telesales. Interactive: customer can be offered with much more different choices in this kind of promotion. ROLE: Normally companies use bombardment of e-mail to many customers and wait for their response. This way have been used a lot now days and is becoming less effective as people always consider them as junk e-mail. Another way of e-marketing is using social websites like facebook to introduce or advertise the product. E.g. durex used this kind of strategy and introduced some games on social networking website to increase the sale. Another way is cataloging, where the businesses send the people to drop the catalogue and the consumer can call and order the product. Last but not least now they use special television channels and phone calls to inspire and get some business from the potential customers. CRITICAL ANLYSIS: As from all the information we have seen the characteristic which are most probably advantages while in introduction of ever kind of promotion I have discussed some disadvantages as well to make sure that the business using any kind of this can know the harmful and useful points of their promotion and the role tells us the importance of the particular communication mix. IMPORTANCE: The importance of marketing communication mix can also be felt when we see that it is connected with the marketing mix. The research on this started from 1940. It flourished with the entrance of new media. Businesses always try to use communication mix to get the share and attention of market. Due to increased competition level we can use one of the tools to acquire new customers in the market. Right communication mix can be used by realizing right target customers. SELECTION OF RIGHT COMMUNICATON MIXES: As we discussed earlier about the I-phone, we will now see how the product should be advertised through out its life cycle to make it a success. PRODUCT LIFE CYCLE: First stage is pre introduction stage where we use very small amount on advertising and just to let people know that we are launching some new product. On 2nd stage i.e. introduction we use PR and advertisement. On3rd stage of growth we need heavy amount of money to be spent in order to make product successful in the market. At maturity level we use less advertising as a tool but now we use more and more sales promotion and PR. At the decline we use sales promotion but some company might use direct marketing as a tool as well to provide customers with good offers. The first and foremost thing for any campaign is that it should know who their target market is and what age group they are looking for. Then depending on their objective they can use one of the models to solve their problem. COMMUNICATION OBJECTIVE: Depending on market type the company or business should enter in, the business should decide their communication objective depending on their product and policies. Depending on your product, target market and business you can select the model and decide what should be the strategy from pre introduction stage till the decline stage. For example in case of an innovation free trial is important. Apple used this kind of strategy when they allowed people to take computers, pc or laptops to home and could use it over the weekend as trial and can buy it after they think the product is efficient enough for use. COMMUNICATION LANDSCAPE: According to Kotler (2008) businesses are moving towards the focused marketing rather than mass marketing. The businesses use the tool of advertisement and promotion in the places where they should and only focus on their target market and people rather than the old technique of sending their message to many people which may result as one of the do the transaction. People do not pay attention to ads and promotion of the product they might not be interested in, most of the time they try to skip the section of advertisements and breaks while watching TV. So it is important to have the right focus group now days to increase sale and transactions. Kotler and his fellow writers used word of broadcasting which is to play the advertisement for mass media thinking that it might result in transaction. The other word he used was narrowcast where only interested and potential customers are target. He used these terms in his â€Å"shifting marketing communication model†. According to them due to change in ICT and presence of internet people are motivated to use online sources to watch their favorite programs and skip the ads in between the breaks. Only few people might watch those. Although mass media like TV and radio is evergreen but is decreased because of presence of internet. An average person spends 5 times more time on internet than TV. All 5 communication mix together can lead to a good business, as they all can be used depending on life cycle of the product. The communication objectives should be kept in mind for a successful business. Depending on the product the message should be designed appropriately to reach to the audience. RECOMMENDATIONS: Businesses should identify their needs first. Businesses should try to fix the budget for promotional and advertising purpose. Businesses should allocate resources in case of no resource available to keep the campaigns going. Business should also allocate fixed amount of money or products to PR as well. Sales promotion times should not be fixed on introduction time. The message should be designed professionally and to the perfection. For the products affordable method should be chosen. The business should try to use same logo or slogan for their products. PR should try to use news release and other form of media to improve reputation of the company. Checks on sale should be carried out by the business in order to find most effective communication mix for their company. HM Analysis: Ansoff Matrix, Five Forces and PEST H and M is a Swedish worldwide company which operates in the fashion sector. Its main competitors are INDITEX, GAR and Arcadian Group. The firm offer fashion cheap quality products on more than 2000 stores placed in 37 countries including Europe, Asia, North America and Middle East. It tries to adapt their products and their business model to the new market to facilitate the entry in a different cultural market country. The company has a strong corporate social responsibility concept and is involved in community and environmental projects; however it has been criticized due to several scandals. Despite of the economic crisis which causes a huge drop in the consumption and therefore in the fashion spending; HM thanks to its policy of low prices is still a quite strong company and has a good financial reputation as its results and ratios show us. The profitability of this company is due to the coast leader strategy that it has followed, focused on the outsourcing of the manufacturing process to countries with low labour costs, which allows HM to sell cheap products and obtain high profits. Also the blame for this business successful is the differentiation strategy that they have developed with the help of celebrities and famous designers lines. Introduction to the company HM (Hennes Mauritz) is an internationally famous company which operates in the fashion industry and besides it also markets cosmetics and accessories. It was founded in Sweden in 1947 by Erling Pearson. In order to know its market share, we must say that in 2009, sales including VAT reached SEK 118,697 millions; furthermore, the number of employees is around 76,000  [1]  . Geographical markets The company has around 2000 stores in 37 countries worldwide, specifically in the European, Asiatic, North American and Middle East market. Germany represents the biggest market with the 25% of HMs total shares, followed by United Kingdom and Sweden. As curiosity we can say that Glasgow has 7 HMs stores. Related to the importance that online selling has nowadays, this service is now available in Sweden, Norway, Denmark, Finland, Netherlands, Germany, Austria and UK.  [2]   Brands and products HM Group includes the brands COS, Monki, Weekday, Cheap Monday and HM home. The firm designs cheap yet chic clothing, offering this to the different segment markets (ladies, men and kids). Mission, values and goals HM describes its mission as Fashion and quality at the best price. In connection to the values, this company is driven by simplicity, continuous, improvement, team spirit, cost-consciousness and entrepreneurship. A sentence that can summarize HM values is the slogan We believe in people. Finally, HM goals are to intensify the sales in the existing stores, as well as, to increase the number of new stores by a net 10% to 15% per year. Expansion and maintaining of financial stability are HMs strategic goals. The growth, which is fully self-financed, will proceed with an emphasis on quality and continued high profitability.  [3]   Corporate Social Responsibility The company guarantees that its products are manufactured under good conditions. According to Karl-Johan Persson (CEO at HM) Being responsible is not only the right thing to do, it makes perfect business sense. (HM 2010) According to the HM 2009 Annual Report, HM acts in many markets as both a buyer and a seller. This requires HM to act responsibly and in a sustainable way with respect to the environment and social responsibility.  [4]   HM is very concerned with the supply chain working conditions, so because of that its very careful choosing the countries for the production and it also imposes a strict Code of Conduct  [5]  to its suppliers. Around sixty auditors works checking that this Code is being respected The company has environmental requirements on suppliers, as a clean production chain, green transport and sustainability policy and vision by sustainable use of resources and healthy products like the organic cotton. According to projects and cooperation, HM has developed community activities, like education and employment of woman and youth, water and innovation of sustainable textile materials. Furthermore, HM reports activities and progress on its sustainability programmes annually.  [7]   However, HM has starred in several scandals, for instance because they discarded bags of unwanted clothes outside HMS store in New York. These clothes could have been used by needy families in case not to have been intentionally damaged to avoid re-use. Besides, in March 2010, the company was criticized by pro-Palestinian groups for opening its first stores in Israel at the time when the UN Goldstone report highlighted Israels alleged violations of international law. The Enterprise Act 2002 which has wide-ranging implications for businesses and consumers. The Electronic Commerce Regulations 2002 includes the information that the company must share with online customers and regulates advertising. Distance Selling Regulations 2000: these laws are aimed at businesses that sell goods or services to consumers by the internet, mail order, phone or fax. The Competition Act 1998 which forbid certain types of anti-competitive behaviour. Its also remarkable that in 2009 the Swedish corporate tax rate was reduced to 26.3 from its previous level of 28%. Trading agreements: most of the HM business is located in EU countries -such as Germany and the UK- without custom duties. ECONOMIC: Although the GDP dropped because of the crisis, it has increased by the 1.2% in the second quarter 2010.  [8]   Since March the 5th 2009, the official bank rate is placed in 0.5%  [9]  , because of that the investment cost is low. Consumer spending on clothing rose by just 10%  [10]  between 2004 and 2008, well below the 19.2% increase in overall consumer expenditure during this period. Even though 2009 has been characterized by deflation, the inflation rate is again positive (1.14 in September 2010)  [11]  . That is to say the demand is starting to rise. SOCIAL Due to the social and environmental conscience, HM has to adapt its policy and products to the new customer awareness. Fashion is more and more interesting for young people and that is the reason why this consumer group spends a high part of its incomes on clothes. Customers seem to prefer customized garments. These kinds of products are supplied generally by online sellers but can represent a competence. Fast changing fashion styles make the designers to be ready for a reply. HM is operating in Middle East and in Asia, therefore it should take into account the social and cultural differences (religion, language or roles of men and women in the society) TECHNOLOGICAL: Technology to make clothing: more updated machines are necessary to accomplish certain colours and patterns. This was due to the heavy investment that HM was doing in its international expansion and in new initiatives. 21 The chart shows us that Primark has solvency problems so it could have problems if interest rates are going up. Competitive strategy 4.1 Porters five forces analysis In this paragraph, Im going to use Porters five forces analysis to determine the intensity of competition and profitability that can be expected in the fashion retail sector. However, in manufacturing there are important barriers to entry due to the scales economies and to the high investment capital required. Fashion products have a high margin. Threat of substitute products For the fashion sector we must talk about replacing brands, not products. There are a lot of fashion retailers in the market which HM is present. Besides, the demand is very variable in this market because of the continuous changes in customers needs and requirements. Relation between quality and price is improving because of the outsourcing of manufacturing in countries with lower labour costs. Bargaining power of buyers One negative aspect is the almost nonexistent loyalty in the cheap fashion segment. Also the switching costs are low. Price is a very important variable for customers. Among the positive aspects its important to say that the volume of purchase is small, that is to say a single buyer is irrelevant for the company. Apart from customers association, they are not very well organized to defend their interests. Bargaining power of suppliers It is not very high because there are a lot of suppliers in countries with low labour costs. That is to say, retailers can impose the demanding conditions because they have more power than suppliers. Rivalry among existing firms in the fashion industry There are a lot of existing local, national and international competitors. The opportunities to growth are not very high because of the maturity of the sector. The price variable is very influential in consumers when considering alternatives. The quick changes in customers requirements do not permit to develop strong scale economies. In this market is very important the good image of the brand worldwide.  [25]   7.2 HM competitive strategies Cost leadership It is a strategy based on scale economies and in the outsourcing of the manufacturing process to countries with low labour costs. In this way the company can offer low prices  [26]  without losing quality and besides being profitable. Thanks to it, the company can self-finance to increase the number of stores and the sales. HM mission is offering quality at the best price. Differentiation strategy This strategy was implementing few years ago. Celebrities and famous designers have created exclusive collections for HM  [27]  . Thanks to these collaborations, the company achieves to differentiate in the fashion retail market. This phenomenon is called masstige  [28]  , and can be defined as an alliance between a prestigious brand and a mass consumer brand. Thanks to it, consumer can buy a branded product at an affordable price. Masstige is formed by two words mass market and prestige Customers perceive that HMs have an added value in comparison with other competitors and they are willing to pay a premium price for them. It the short run the company improves its turnover and in the long term it builds a stronger brand awareness and prestige that it could use to penetrate in difficult markets. 5. Strategic directions of development I am going to use Ansoffs matrix to analyze the main strategic directions followed by the company through the product and market: C:Userspelegrià ±PicturesAnsoff-Matrix.gif  [29]   Market penetration: This strategy is used to increase existing products sales in the current market. This can be achieved gaining competitors customers and encouraging them to acquire more companys products. HMs key for market penetration is offering fashionable clothing with cheaper prices than other competitors like Zara  [30]  . Doyle (2002) argues that the foundation of a successful brand is quality. The company is very concerned about that, therefore it has comprehensive quality control methods which guarantee customer satisfaction. Thanks to the strong advertising campaigns the company has increased its popularity worldwide helped by the globalization of fashion trends and lifestyles. Market development: Lynch (2003) says it involves targeting new segments of a market, identifying new uses for the companys products or entering new international markets. HM internationalization strategy is based on entering one market at a time. Although the standardization of HMs products, the company introduces slight variations to be adapted to the new market culture. According to the new market segments, the company has launched COS (Collection of Style) with more expensive and smarter clothes than the HMs common one. Product development It can be defined that offering really new and innovative products to the current customers. HM develop this strategy, for example, through strategic alliances with famous designers and fashion icons like Karl Lagerfeld, Madonna or Roberto Cavalli which improve HMs prestige worldwide. Furthermore, the company concerns about research and development, for instance, it introduced environmental friendly materials like organic cotton in its 2008 Spring Collection and then along its entire range of products. Also it is important to underline here that HM has created perfumes, cosmetics and beauty products. Besides as I have said in the introduction HM has a home line available on the internt. HM has been focusing in fashion items like clothes, jeweler, shoes, bags or accessories so it has not developed very much this strategy. Only they have performed a diversification strategy, specifically household items through HM Home.  [31]   The company has also developed curious products such as the stuff pack for the computer game The Sims 2 called Fashion Stuff Pack in June 2007 in collaboration with Maxis game developers. 2 6. Methods of development In this section, I am going to analyse the methods of development used by HM in the recent years, and besides the benefits and challenges that each one involve. Lynch (2003) said that HM has followed a forward vertical integration strategy as method of growth. This means that the company develops activities oriented to customers, the final product and the distribution network (retailing) more than related with suppliers (backward integration). Thanks to this strategy, the company can collect information about sales and customers needs to reply quickly to changes in the fashion market. HM and Zara are known as fast-fashion retailers. This has permitted them to expand successfully in Europe, Asia and America. However, they have a different internationalization strategy, because HM tends to adapt its products and strategy o the new market while Zara reproduces the original successful business model in all the markets. Zara prices vary depending on the country while HM has the same price in all the markets in which it is present HM is a strong financially company which seeks to maintain a good profitability in its growth strategy. We can say that the growth is substantive but also controlled. The growth goals are to increase the number of stores by 10-15% per year, as well as increasing sales in existing stores. In the last five years, the company has had a great growth in number of stores, turnovers and earnings per share. Focusing on HMs geographical expansion, its first store abroad was opened in Norway in 1964. Then it continued with the expansion in UK, Denmark, Switzerland and Germany. In the 1990s, it opened stores in Finland, France, Belgium, Austria, Portugal, Spain and the Netherlands. The first store in US was opened in New York in March 2000. The first store in Asia was in Dubai in 2006, and thanks to a franchising strategy. After this, it entered to East Asia by opening stores in Hong Kong and Shangai  [32]  in 2007. Japan in 2008, Russia in 2009 and Corea in 2010 were the following countries to enter. The two first Israeli stores opened in 2010 and as I said in the introduction there were pro-Palestine group protests. It is planned to open new stores in Croatia and Singapore for 2011. HM main method of entry is an organic growth by opening is own stores in the new market. But we can see also that since 2006 the company has followed a franchising strategy in Middle East to open 3 stores in Dubai in agreement with M.H. Alshaya, a company from Kuwait specialized in holding franchises with international retail brands. In this paragraph I am going to use the SPACE matrix (Strategic Position Action Evaluation matrix) which is a management tool used to analyze a company and to determine what type of strategy it should undertake. Rowe et al. (1989) developed this model based on four important variables: The stability/ turbulence of the environment Industry attractiveness The competitive advantage The companys financial strength Throughout this report I have analyzed these variables, therefore it can be argued that HM is a strong financially company, as the sales, profits and financial ratios show. To determine the industry attractiveness it is useful the Porters five forces seen in the section 4. Following with the environmental stability we can use the PEST analysis done in the section 2 and for the competitive advantage it has to be taken into account the strategic directions and the methods of development. After having analyzed all these points and drawing the SPACE matrix, it can be concluded that HM should follow an aggressive strategy. HM has a strong competitive position in the market (a known brand worldwide) and a quite good financial position to support this strategy. It needs to use its internal strengths to develop a market penetration and a market development strategy. In fact it is the strategy that HM has been followed in the last years, as the expansion to Asia and Middle East show (market development strategy) and opening more and more stores in the existing markets such as Europe (market penetration). As recommendations, it can be suggested that the company entered South American market by performing a market development strategy. HM has not arrived yet to this market and it would be very interesting due to there are a lot of customers in this market interesting in buying fashion cheap clothes and the company could adapt quickly to the South American market culture, gaining ground to its competitors within a market full of opportunities to growth. On the other hand as a market penetration strategy it can be suggested to follow with the opening of new stores in the current market, increase the size of the existing stores and try to manage present products and services more effectively.

  Ã‚  Ã‚  Ã‚  Ã‚  When Aldous Huxley wrote Brave New World in 1931, nobody imagined that his fairytale story would someday be a reality. It is almost scary to see how accurate Huxley’s far-fetched fantasies came to be. When Huxley wrote about the conformity, drug use and sex and technology of the society, he was almost pinpoint exact to predicting today’s societies. Unfortunately, all of these things haven’t exactly changed our society today for the better.   Ã‚  Ã‚  Ã‚  Ã‚  It is amazing to see how accurately Aldous Huxley was in his predictions to human conformity today. The novel’s classes of Alphas, Betas, Gammas, Deltas and Epsilons each have assigned roles. In the novel, each caste is brainwashed into believing that it is crucial and important for the well being of the society as a whole. Since everyone is brainwashed at such an early age, nobody really questions the order or rules. However, there are always those few who refuse to conform. The novel’s John, Helmholtz Watson, and Bernard Marx were all exiled from their society by the World Controller Mustapha Mond. Their actions involving the soma in the hospital were considered far too disruptive to society and they were no longer allowed to co-exist in the preset world of Ford. Our own world is very similar to the world of Ford as we ‘exile’ all who are different. One example of a group whom our society’s majority refuses to accept is the gay population. They could, of course, chose to go against their ways and date the opposite sex just so that they would be accepted, but because they do not, most people refuse to accept that and therefore exile them. The conformity struggle starts as young as elementary school. Popularity is based upon those who conform the best and follow everyone else and unfortunately, those who are different and stand out are usually harassed for their differences.   Ã‚  Ã‚  Ã‚  Ã‚  Drugs are one of the most copious problems that exist today, as we are beginning to see more and more of them in today’s society. Drugs have even become commonly used by today’s youth starting as low as elementary school. The need to feel that ‘high’ has become more and more common. Unfortunately, the drugs used in today’s society aren’t as safe as those used in Huxley’s world. â€Å"Soma† is the drug of choice in Huxley’s world which gave similar ‘highs’ as does ecstasy, but did not have the harmful side effects.

Essay on Voltaire’s Candide: The Accuracy of Candide -- Voltaire Candi

  Ã‚  Ã‚   Voltaire is correct in Candide, where he argues that life on earth is hell in many ways. Voltaire accurately describes how selfish people often are and how they inflict misery on others as a result. Voltaire also describes accurately common forms of cruelty in society. Although he may be mistaken that all wars are equally senseless and avoidable, Voltaire is correct in showing that war inevitably produces atrocities, which makes for hell on earth.  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   In support of these statements, let's examine Voltaire's accurate description of human selfishness.  Ã‚   An example would be the behavior of the sailor who Pangloss and Candide met on their voyage to Lisbon.   This sailor was rescued from drowning by Jacques the Anabaptist. Yet when Jacques fell into the sea himself, the sailor refused to risk his own life to save him. As a result of this selfishness, Jacques died. Later on, when the sailor reached shore, he ignored the sufferings of people horribly injured by a recent earthquake. Instead the sailor took money from them in order to get drunk and hire a prostitute. This sailor was wholly self-centered and uncaring about anyone else and by not helping anybody out he in effect inflicted misery on them. When the terrorists destroyed the World Trade Centers, and many police and firemen were killed, many people received money for relatives that did not die, and used the money for gambling, booze and whores. Human nature in this regard has not changed since the book was written. This being so, Voltaire's description of how human selfishness can often turn life on earth into a hell is accurate.     Ã‚   Voltaire's depiction of how common cruelty is in society is also well supported. For example, Voltaire describes how Candide en... ... again as an example, there were many instances of people who risked their own lives to save others and as a result received citations and promotions as well as the admiration of their family and friends. This objection to my argument, however, does not take an important thrust of Candide into account. That is, that Voltaire felt that he had to use exaggeration and one-sided presentation to make sure his audience did not refuse to contemplate deeply just how much cruelty and selfishness exists at all times all around them and how much people suffer because of that. “What I Saw and How I Lied”

Why do we go through love, deceit, the pains of growing up, and figuring out who we are? The four things I have listed are not only themes in the book â€Å"What I Saw and How I Lied† by Judy Blundell, but some basic parts of life. Love is a complicated feeling, not only for you and the person you’re in love with but the people around you. Sometimes when you are in love with somebody, not everyone approves, and that brings complication because you want to be in love with whoever you want, but also please the person who doesn’t approve because you love them too, in a different way, of course.Deception also comes into play when it comes to the game love. When in love with someone the feelings should be mutual, if there is no mutuality then one of the two people in the relationship is being deceived. In all it only leads to constant deception and heart ache. There’s a very true and popular saying; â€Å"growing up is hard to do. † In life as we grow ol der we all have obstacles we have to face. Whether it’s getting along with your mom or trying to fit in, that’s just two examples out of thousands, these obstacles are not meant to torment you but only to prepare you for life in general and the many more obstacles to come.When it comes to figuring out who you are it’s just one of the hurdles on the track of life you have to jump and hope you don’t have to try again, but if you do you will. When you clear the jump, finally figuring out who you are there is a sense of completion and just another step to success in your life. Evie a fifteen year old girl, the main character, felt she was growing up the only thing stopping her was her mother, she felt as if her mother wasn’t allowing her to grow up.Evie’s mother wouldn’t do anything to give Evie a sense of growing up, she wouldn’t buy the kind of clothes girls her age wore, she wouldn’t let her wear her hair the way she want ed, and she certainly didn’t let her date boys. On the contrary though, Evie was determined to prove she was grown up she felt that to appear grown up you had to start with your physical appearance. â€Å"I want to wear lipstick. † Her mother was just as determined to prove to her that Evie shouldn’t want to row up too fast. â€Å"Don’t be in such a hurry to grow up, baby. † Evie knew it was going to be hard to prove to her mom, let alone herself, that she wasn’t a little girl anymore. Little did they both know Evie was going to a lot of growing up on their spontaneous trip to Palm Springs, Florida. Evie was very excited for their getaway, she thought this was her chance to prove she was grown up. Her plan to prove it to them was to show she could handle a relationship, but in all reality she couldn’t.Evie met a man name Peter and she fell in love with him, although it was forbidden. He was too old for her, and in her mother’s opinion she was too young to date. In addition, her step-father didn’t like him because they had some bad history together when they were in World War II together. Throughout the story Evie and Peter continue their forbidden relationship, meanwhile Peter is also having an affair with Evie’s mother. â€Å"You lied, you told me you loved me!†¦ Mom, you knew the whole time! This is where the deception comes in, not only was Evie being deceived by her own mother but by the man she thought loved her. The whole time Evie thought she was discovering maturity and love but in all actuality she discovered deception and betrayal. Sure deception and betrayal will make you do a little growing up, but only by getting rid of your naivety. Growing up should be a treasured part of life not tragic. For Evie becoming a mature young adult was tragic. She never learned what true love is, to be faithful and devoted to one another.The only good thing Evie learned is who she is, she fig ured out that she shouldn’t trust every new person that comes into her life with her feelings. In closing love, deceit, growing up, and figuring out who you are in life is hard, but they’re part of life and everybody goes through it. Although we all go through life differently, it’s still life, we have no choice but to go through it. We choose who we love and trust and the choices we make determine how far we go in life. The question is why does life have to be so challenging?
